To All to whom these Presents shall Come, Greeting:

KNOW YE, that the Will of Thomas C. Davis deceased, a copy of which is hereto annexed, has been duly proven in the County court for the County aforesaid, and that Nancy A Davis who is named executor therein, has been duly appointed such executor by the Court aforesaid; this, therefore, authorizes the said Nancy A Davis to administer the estate of the said Thomas C Davis deceased, according to law.

IN TESTIMONY WHEREOF, I, Geo. W. Briedwell

and affixed the seal of said Court, this Seventh

I do solemnly swear that I will support the Constitution of the United States and the Constitution of the State of Oregon, and that I will faithfully perform, according to law, the duties of Executrix of the Estate of Thomas C Davis deceased, so help me God.

Know all men by these presents that I Thomas C Davis a farmer by occupation and residing at North Yamhill Yamhill County in the State of Oregon, aged 62 years past, and being of sound and disposing mind and memory and understanding, and being desirous of directing how my estate shall go at and after my decease, do hereby make publish and declare this to be my Last Will and Testament hereby revoking any and all wills by me at any time heretofore made and that is to say

First: I desire that all my debts, funeral expenses and expenses of administration, be first paid by my Executrix hereinafter named.

Second: I desire that a decent tombstone be placed at my grave, and that my executrix pay for the same out of any money or property I may have.

Third: I will and devise and bequeath unto my wife, Nancy Ann Davis, in lieu of all dower, the dwelling house barns and improvements on my farm where I now live together with fifty acres of said farm upon which said buildings are in a convenient square to be surveyed off, to have and to hold the same to my said wife, for her natural life, with remainder in fee simple to my devisees in the manner and upon the Conditions hereinafter named.

Fourth:I give devise and bequeath unto my Said wife, all my household goods and furniture and all my personal property, except money notes and accounts, and I will here one fifth of all my said money notes and accounts, after the payment of all debts, funeral expenses and specific legacies.

Fifth: I give devise and bequeath unto Sarah Elizabeth Prentice wife of John Prentice, One Thousand Dollars as a Specific legacy, if she shall at my death, be his wife, and this in lieu of all her interest in my real Estate; but if she shall not be the wife of John Prentice at my death, she shall not have this specific legacy, but instead thereof, she shall have an undivided one fourth interest in all my real Estate, subject of Course to the devise to my said wife. In addition to this bequest, I will her my said daughter absolutely one fifth of all my money notes and accounts left after payment of all debts, funeral expenses and specific legacies.

Sixth: I give devise and bequeath unto my daughters Mary Margaret Davis, Eliza Jane Kuykendall, and Isabel Hines Baird, each one fifth of all my money notes and accounts, after payment of all debts, funeral expenses and specific legacies, and if their sister Sarah Elizabeth Prentice, shall at my death, be the wife of John Prentice, there and in that event, I will devise and bequeath unto each of them the said Mary Margaret Davis, Isabel Hines Baird and Eliza Jane Kuykendall, subject to said devise to my said wife, each an undivided one third of all my real estate, but if my said daughter, Sarah Elizabeth Prentice, shall not at my death, be the wife of said John Prentice, then I will devise and bequeath unto each of my said daughters, an undivided one fourth of all my real estate.

Seventh: I hereby appoint my wife Nancy Ann Davis Executrix of this Will and I request that she act without bonds.

The foregoing instrument consisting of this sheet of legal cap was now here signed sealed published and declared by the said Testator Thomas C Davis as and for his Last Will and Testament and in our presence and in the presence of each other, and we at his request and in his presence and in the presence and hearing of each other, have hereunto set our hands and subscribed our names as attesting witnesses thereto this 13th day of November A. D. 1883
